3. Brokerage Relationship

All brokerage relationships must be established through a written agreement. The specific terms of our representation, including commission structure, duration, and scope of services, will be detailed in separate brokerage agreements such as:

• Exclusive Buyer Brokerage Agreement

• Exclusive Right to Sell Listing Agreement

• Other applicable agency agreements as required by state law

4. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information regarding your real estate needs and financial qualifications

• Act in good faith throughout the transaction process

• Comply with all applicable laws and regulations

• Honor the terms of any executed agreements

• Promptly communicate any changes in circumstances or objectives

• Make timely payments for services rendered as agreed

5. Fees and Commissions

Commission rates and fee structures are negotiable and will be specified in individual brokerage agreements. Standard industry practices apply unless otherwise agreed in writing. All fees are earned upon successful closing of a transaction unless otherwise specified in the brokerage agreement.

In the event of cancellation or breach of agreement by the client, fees may still be owed as outlined in the applicable brokerage agreement.

6. Limitation of Liability

To the fullest extent permitted by law: Broker Builders and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services, including but not limited to lost profits, business interruption, or loss of data.

Our total liability for any claims arising from our services shall not exceed the total fees paid by you to us for the specific transaction or service giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless Broker Builders, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your breach of these Terms, violation of any law, or infringement of any third-party rights.

8. Disclosures and Disclaimers

Property Information: Information about properties is obtained from sources believed to be reliable but is not guaranteed. We recommend that clients conduct independent inspections, surveys, and due diligence.

Market Conditions: Real estate markets fluctuate. Past performance is not indicative of future results. We make no guarantees regarding property values, sale prices, or market timing.

Professional Advice: We are not attorneys, accountants, inspectors, or appraisers. You should seek independent professional advice regarding legal, tax, structural, environmental, and other specialized matters.

Dual Agency: In some transactions, we may represent both buyer and seller with proper disclosure and consent as permitted by law. Potential conflicts will be disclosed in accordance with state regulations.

9. Fair Housing Compliance

Broker Builders is committed to compliance with all federal, state, and local fair housing laws. We do not discriminate based on race, color, religion, national origin, sex, disability, familial status, or any other protected class. Any client requests that violate fair housing laws will be declined.

10. Intellectual Property
